The announcement of President Obama created a lot of excitement within the immigrant community. In moments like this, notario and other people not authorized to practice law take advantage of the unlawful immigrant's vulnerability.
Please be aware because at the moment there is nothing that can be done or filed;
Please be aware because it is not everyone who qualifies for the relieves provided;
More importantly, please be aware because besides stealing your money, the wrong help may harm your chances of obtaining immigration benefits, such as the green card and eventually, citizenship.

How Florida's acceptance of same sex marriage may benefit international couples?

Everyone is aware that DOMA's definition of marriage as between a man and a woman, was considered unconstitutional. As a result, immigration started to accept and process cases involving same sex married couples. For example: when a US citizen petitions for the green card for the same sex partner beneficiary. However, immigration requires the marriage to take place in a state or country that recognizes the validity of same sex marriage.

Besides its big GLS population, Florida is not a state that recognizes same sex marriage. Nonetheless, recently three Florida judges have declared the Florida ban on same sex marriage to be unconstitutional. Moreover, last week a federal appeals court informed the Florida state attorney general, Bondi, it would not reinstate a federal stay set to expire the end of Jan. 5. That means that same sex marriage is likely to be legalized in Florida as of January 6, 2015.

How could this benefit the GLS population in Florida? If same sex marriage is legalized in Florida, same sex couple won't need to travel out of state to get married and file for immigration benefits. They will be able to do it right here.

Deferred Action for Parents of US Citizens and Lawful Permanent Residents -DAPA

On November 20, 2014, the President announced a series of executive actions one of these actions would allow qualifying undocumented immigrants to received temporary work authorization and stay without fear of deportation.

Below are the requirements to qualify for DAPA:

Have continuous residence in the United States since January 1, 2010;
Be the parent of a U.S. citizen or lawful permanent resident born on or before November 20, 2014; and
Not be an enforcement priority for removal from the United States, pursuant to the November 20, 2014, Policies for the Apprehension, Detention and Removal of Undocumented Immigrants Memorandum. No Criminal records.

Please note: USCIS will consider each request for Deferred Action for Parental Accountability (DAPA) on a case-by-case basis.
It will not start accepting applications for the next 180 days.

Although USCIS has not release any procedures and guidelines for this application, applicants may start gathering some documents to prove 1. identity, 2. relationship to the US citizen or Legal Permanent Resident, 3. continuous residency for the last 5 years or more.
